These Terms and Conditions (“Terms”) govern your access to and use of MediKin Health Reminder (“MediKin,” the “App,” or the “Service”), operated by NeogenXAI, Bhaktapur, Nepal (“NeogenXAI,” “we,” “us,” or “our”).
Please read these Terms carefully before creating an account or using MediKin.
By creating a MediKin account, checking the box indicating that you agree to these Terms, or otherwise using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, do not create an account or use MediKin.
Our Privacy Policy separately explains how personal information and User Content are handled.
1. About MediKin
MediKin is a health organization, reminder, recordkeeping, and informational application.
Depending on the version of MediKin and the features available to you, the Service may allow you to organize or use information relating to medications, medication reminders, appointments, health records, health measurements, documents, scans, conversations, family profiles, Care Circle functionality, challenges, connected health services, and other health or wellness-related features.
Some features are optional and may not be available to every user, device, platform, or location.
MediKin may add, modify, improve, limit, suspend, or discontinue features as the Service develops.
2. Eligibility
You must be at least 18 years old, or the applicable age of legal majority in your jurisdiction if higher, to independently create and operate a MediKin account.
An adult may use supported MediKin features to manage information concerning a child, dependent, family member, or another person only where that adult has appropriate authority or permission to do so.
If you provide information concerning another person, you are responsible for ensuring that you have the lawful authority or appropriate permission to provide and manage that information.
MediKin does not determine legal guardianship, medical decision-making authority, or other legal relationships between users and other individuals.
3. Your Account
You are responsible for providing accurate information when creating and maintaining your account.
You are responsible for maintaining the confidentiality and security of your account credentials and for taking reasonable steps to prevent unauthorized access to your account.
You must not knowingly allow another person to impersonate you or use your account in violation of these Terms.
If you believe your account has been accessed without authorization, contact us promptly at:
contact-medikin@neogenxai.com
4. Information Provided During Signup
When you create an account, MediKin requests certain account and profile information necessary or useful for creating and operating your account.
The information requested during signup may include your name, email address, age or age-related information, gender, time zone, account identifier, and other profile information displayed during the signup process.
Creating a MediKin account does not mean that you are required to provide every category of health information supported by MediKin.
Other information becomes part of MediKin only when you choose to use features that involve that information.
Our Privacy Policy provides additional information about signup information and how it is handled.
5. Your User Content
MediKin allows you to create, enter, upload, save, connect, or generate information through features you choose to use.
We refer to this information as “User Content.”
Depending on the features you use, User Content may include medication records, medication schedules, reminders, appointments, health measurements, symptoms, notes, medical documents, images, scans, conversations, family information, Care Circle information, challenge information, and other information you choose to maintain through MediKin.
You are not required to use every feature.
If you do not use a particular feature, you do not provide the User Content associated with that feature through MediKin.
Ownership of User Content
You retain your rights in your User Content.
NeogenXAI does not claim ownership of your User Content merely because you create, enter, upload, or store it through MediKin.
By providing User Content through MediKin, you authorize us to host, store, process, reproduce where technically necessary, transmit where necessary to provide the requested functionality, secure, and otherwise technically handle that User Content as reasonably necessary to operate and provide MediKin.
You are responsible for ensuring that you have the right to provide User Content you place in MediKin.
6. Privacy
Our Privacy Policy explains how MediKin handles signup information, User Content, analytics information, technical information, product-improvement information, deletion requests, and other information associated with the Service.
We do not sell your private health User Content to data brokers or distribute it to third parties for their own targeted advertising or marketing purposes.
We may use general, aggregated, de-identified, statistical, or non-individual information to understand and improve MediKin.
MediKin also uses analytics services, including Google Analytics, to understand ordinary usage and technical performance as further described in our Privacy Policy.
Your acknowledgment of the Privacy Policy during signup does not automatically constitute consent to every optional feature or future use of sensitive information.
Where a feature requires additional permission or consent under applicable law, MediKin may request it separately.
7. Product Improvement
We may use information about how MediKin is used to maintain, troubleshoot, evaluate, develop, and improve the Service.
Our product-improvement activities are intended to understand product functionality, performance, reliability, errors, feature usage, and general user experience rather than to create individual health profiles for advertising.
Where reasonably possible for these purposes, we may use aggregated, de-identified, statistical, or otherwise non-individual information.
We may use analytics and technical information to identify bugs, understand feature performance, improve usability, and develop new or improved functionality.
Additional details are provided in the Privacy Policy.
8. User Responsibility
You are responsible for your use of MediKin.
You are responsible for reviewing and verifying information before relying upon it.
This includes information relating to:
medications;
medication names and doses;
schedules;
reminders;
appointments;
health measurements;
health records;
medical documents;
scanned or extracted information;
calculations and estimates;
notifications;
information entered by another authorized person;
AI-generated or automated information; and
other information displayed, stored, generated, or organized through MediKin.
MediKin does not independently guarantee that User Content entered by you or another person is correct, complete, current, or medically appropriate.
You remain responsible for decisions and actions you take based on information available through MediKin.
9. MediKin Is Not Medical Advice
MediKin is not a doctor, healthcare professional, healthcare provider, pharmacy, hospital, emergency service, or substitute for professional medical care.
MediKin does not establish a doctor-patient, healthcare-provider-patient, pharmacist-patient, or other professional healthcare relationship between you and NeogenXAI.
Information available through MediKin is provided for organizational, reminder, informational, or supportive purposes.
MediKin does not provide a medical diagnosis.
MediKin does not prescribe medication.
MediKin does not replace advice or instructions provided by your doctor, pharmacist, or other qualified healthcare professional.
You should consult an appropriately qualified healthcare professional regarding medical conditions, symptoms, diagnoses, treatments, medications, medication changes, or other healthcare decisions.
Do not disregard professional medical advice or delay seeking professional care because of information displayed or generated through MediKin.
10. Medical Emergencies
Do not use or rely on MediKin for medical emergencies.
MediKin is not an emergency monitoring or emergency response service.
If you believe that you or another person may be experiencing a medical emergency, contact the appropriate local emergency service, healthcare provider, or emergency medical facility immediately.
MediKin does not continuously monitor your health.
MediKin does not guarantee that it will identify, predict, detect, prevent, or alert you to a medical emergency, medication problem, abnormal measurement, health deterioration, or other health-related event.
11. Medication Reminders and Notifications
Medication reminders, appointment reminders, notifications, alerts, and similar features are convenience and organizational tools.
They must not be treated as guaranteed medical monitoring.
We do not guarantee that any reminder, notification, message, alert, or other communication will be:
delivered;
delivered at the expected time;
displayed correctly;
received;
noticed;
acted upon; or
free from errors.
Delivery may be affected by device settings, notification permissions, operating-system restrictions, internet connectivity, battery settings, network problems, third-party services, outages, software errors, incorrect User Content, maintenance, or other circumstances.
You remain responsible for following medication instructions provided by your healthcare professional, maintaining an appropriate medication supply, attending appointments, and otherwise managing your healthcare.
You should not rely exclusively on MediKin as the only method of remembering medically important actions.
A MediKin status indicating that something is “Taken,” “Done,” missed, overdue, or similar does not independently prove that the underlying action actually occurred.
12. AI and Automated Features
Some MediKin features may use artificial intelligence, machine learning, automated processing, extraction, calculations, or similar technologies.
Automated and AI-generated outputs can be incorrect.
They may also be incomplete, inaccurate, misleading, outdated, or inappropriate for your individual circumstances.
You must independently review important information before relying upon it.
AI-generated or automated information provided through MediKin does not constitute professional medical advice, diagnosis, prescription, or treatment.
Do not use AI-generated information as the sole basis for starting, stopping, increasing, decreasing, or otherwise changing medication or treatment.
Important medical decisions should be discussed with an appropriately qualified healthcare professional.
Where an optional feature requires additional processing or permissions, applicable information will be provided through the Privacy Policy or an appropriate feature notice.
13. Scanning and Document Processing
MediKin may provide features that allow you to photograph, scan, upload, transcribe, extract, summarize, or organize information from medication packaging, prescriptions, medical reports, or other documents.
Automated extraction and scanning can produce errors.
Text may be misread, omitted, incorrectly categorized, or interpreted incorrectly.
You are responsible for reviewing extracted or transcribed information against the original document before relying on it.
The original document and instructions from qualified healthcare professionals should take priority over an automated extraction where there is a discrepancy.
14. Health Measurements and Calculations
MediKin may allow you to record measurements, calculate schedules, estimate quantities, display trends, or generate other calculated information.
Calculations and estimates depend on the information available to the Service.
Incorrect, incomplete, outdated, delayed, or missing information can produce incorrect results.
MediKin calculations and estimates are informational tools and should not be treated as professional medical determinations.
You are responsible for verifying medically important calculations or information with an appropriate healthcare professional.
15. Family Profiles and Information About Other People
MediKin may allow an authorized adult to create or manage information for a dependent, family member, or another person.
If you create, enter, upload, or manage information concerning another person, you represent that you have appropriate authority or permission to do so.
You are responsible for the accuracy of information you provide concerning that person and for managing it appropriately.
MediKin does not independently verify every family relationship, guardianship arrangement, caregiving relationship, or other authorization.
16. Care Circle and Sharing
MediKin may provide features allowing you to share selected information with another person.
You are responsible for deciding:
whether to share information;
what information to share;
whom to share it with; and
when to revoke access.
Before sharing sensitive information, make sure you have selected the intended recipient and appropriate permissions.
Once another person has legitimately received information, MediKin cannot control what that person does with copies made outside the Service.
Revoking MediKin access cannot delete screenshots, photographs, downloads, notes, exports, or other copies independently retained outside MediKin.
17. Connected Health Services
MediKin may allow optional connections to health platforms or other supported services.
You decide whether to enable an available integration and grant the permissions requested by the applicable platform.
Information supplied by an external health platform may be incomplete, delayed, duplicated, inaccurate, unavailable, or affected by that platform's own systems.
MediKin does not guarantee the accuracy or continuous availability of information originating from third-party devices, wearables, health platforms, operating systems, or other external services.
18. Third-Party Services
MediKin may depend upon third-party technology and infrastructure, including services for hosting, authentication, storage, analytics, email delivery, operating-system functionality, app distribution, security, and other technical functions.
Third-party services may experience interruptions, errors, outages, security incidents, changes, or discontinuation beyond NeogenXAI's control.
Where you independently choose to leave MediKin and use a third-party website, application, platform, or service, your use of that external service is subject to its applicable terms and privacy practices.
19. Acceptable Use
You agree not to misuse MediKin.
You must not intentionally:
access another person's account without authorization;
impersonate another person;
provide information about another person without appropriate authority;
attempt to circumvent authentication or security controls;
probe, scan, or test MediKin for vulnerabilities without authorization;
introduce malware or malicious code;
interfere with the Service or other users;
overload or disrupt MediKin's infrastructure;
use automated systems to abuse the Service;
attempt to obtain information you are not authorized to access;
use MediKin to violate applicable law;
infringe the rights of another person; or
use MediKin for fraudulent, harmful, or abusive purposes.
We may restrict, suspend, or terminate access where reasonably necessary to protect MediKin, its users, NeogenXAI, service providers, or others.
20. Your Responsibility for Devices and Connectivity
You are responsible for maintaining a compatible device, appropriate operating system, internet connection, device security, notification settings, permissions, and other equipment or services required to use MediKin.
NeogenXAI is not responsible for failures caused by your device, operating system, internet provider, network, notification settings, battery settings, storage limitations, permissions, or other systems outside our reasonable control.
You are responsible for protecting access to your device where MediKin contains sensitive information.
21. Data Deletion
You may request deletion of your User Content or your entire MediKin account at any time.
Deletion requests may be submitted through available MediKin account controls or by contacting:
contact-medikin@neogenxai.com
We may take reasonable steps to verify that a deletion request was submitted by the account holder or another authorized person.
Once we receive and verify a valid deletion request, we will complete deletion of the requested personal information from our active systems within 30 days, except where continued retention is required or otherwise permitted by applicable law.
Information may remain temporarily in protected backups until those backups are overwritten or expire through our ordinary backup-retention process.
Information retained because of a legal obligation, security requirement, fraud-prevention need, dispute, legal claim, or similar lawful reason will be limited to the applicable purpose.
Deleting MediKin from your device does not by itself delete your account or information stored on MediKin systems.
Deleting information from MediKin also cannot delete copies another person has independently retained outside MediKin.
Additional information about retention and deletion is provided in our Privacy Policy.
22. Availability of the Service
MediKin may not always be available.
The Service may be temporarily or permanently affected by:
maintenance;
software bugs;
hardware failures;
infrastructure problems;
internet outages;
service-provider failures;
operating-system changes;
device incompatibilities;
security events;
upgrades;
feature changes; or
circumstances beyond our reasonable control.
We may modify, update, replace, suspend, limit, or discontinue some or all of MediKin where reasonably necessary.
We do not guarantee that any particular feature will remain available indefinitely.
23. “AS IS” AND “AS AVAILABLE”
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MEDIKIN IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS.
You acknowledge that software, online services, automated systems, AI systems, networks, devices, and third-party services can contain faults and can fail.
NeogenXAI does not warrant or guarantee that MediKin will:
operate without interruption;
always be available;
be error-free;
be fault-free;
be bug-free;
be completely secure;
be completely accurate;
be complete or current;
operate correctly on every device;
be compatible with every operating system;
preserve every record without error;
successfully synchronize every record;
deliver every notification or reminder;
generate accurate calculations or estimates;
correctly extract every document;
produce accurate AI-generated information;

remain available indefinitely.
Errors, omissions, delays, interruptions, incorrect outputs, synchronization problems, failed notifications, data-entry mistakes, technical failures, and other faults may occur.
You use MediKin at your own risk to the maximum extent permitted by applicable law.
24. User Responsibility and Independent Verification
You remain ultimately responsible for decisions you make and actions you take in connection with your health, medications, appointments, records, User Content, and use of MediKin.
MediKin should be treated as an additional organizational tool rather than your sole source of medically important information.
Where information is important, you should maintain appropriate independent records or other safeguards.
You are responsible for verifying information before relying upon it, particularly where an error could affect your health, safety, medication, treatment, finances, legal rights, or another important interest.
You are responsible for seeking professional assistance when appropriate.
NeogenXAI does not assume the responsibilities of your doctor, pharmacist, caregiver, healthcare provider, emergency service, or other professional merely because you use MediKin.
25. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NeogenXAI and its owners, directors, officers, employees, contractors, representatives, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, consequential, or similar losses arising out of or relating to MediKin or your use of or inability to use the Service.
To the maximum extent permitted by applicable law, this includes losses arising from or relating to:
reliance on information displayed through MediKin;
inaccurate or incomplete User Content;
medication reminders;
missed, delayed, duplicated, or incorrect notifications;
appointments;
incorrect schedules;
calculations or estimates;
AI-generated information;
automated extraction;
scanning or transcription errors;
synchronization failures;
unavailable features;
software bugs or defects;
service interruptions;
device or network failures;
information provided by another user;
information originating from a third-party service;
your failure to verify information;
your failure to follow professional medical advice; or
your use of MediKin contrary to these Terms.
You remain responsible for medical and healthcare decisions and for obtaining appropriate professional medical assistance.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
Nothing in these Terms removes mandatory consumer rights or other legal protections that cannot lawfully be waived.
26. No Guarantee Against Data Loss
Although we may implement measures intended to protect and maintain information, no digital storage system can guarantee against all loss, corruption, deletion, unauthorized access, or technical failure.
You should not use MediKin as the sole repository for information where loss of that information could create a significant health, safety, legal, financial, or other risk.
Where appropriate, you are responsible for retaining independent copies of important information.
27. Security
You must not attempt to compromise MediKin's security.
We may take reasonable measures to protect the Service, investigate suspected misuse, prevent unauthorized access, and respond to security threats.
No internet-connected system can guarantee absolute security.
You acknowledge that use of an online service involves inherent technical and security risks.
Our handling of personal information following applicable security incidents is governed by our Privacy Policy and applicable law.
28. Intellectual Property
MediKin's software, interfaces, designs, branding, logos, graphics, documentation, original text, and other materials created by or for NeogenXAI are owned by or licensed to NeogenXAI and may be protected by intellectual-property laws.
These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use MediKin in accordance with these Terms.
They do not transfer ownership of MediKin or NeogenXAI intellectual property to you.
Your User Content remains subject to the rights described in Section 5.
29. Feedback
If you voluntarily provide suggestions, ideas, comments, bug reports, feature requests, or other feedback concerning MediKin, you permit NeogenXAI to use that feedback to evaluate, develop, and improve MediKin without an obligation to compensate you.
This does not transfer ownership of your private User Content to NeogenXAI.
30. Suspension and Termination
You may stop using MediKin at any time.
You may request account deletion as described in Section 21.
We may suspend, restrict, or terminate access where reasonably necessary because of:
serious or repeated violation of these Terms;
unlawful activity;
fraud or abuse;
security threats;
unauthorized access;
risk to other users or the Service;
legal requirements; or
circumstances that make continued operation of the account or Service reasonably impracticable.
Where appropriate and required by applicable law, we will provide notice.
Provisions that reasonably need to survive termination—including provisions concerning intellectual property, disclaimers, limitations of liability, and applicable legal obligations—will continue to apply after termination to the extent permitted by law.
31. Changes to MediKin
MediKin is an evolving product.
We may release updates, modify functionality, redesign features, add features, remove features, change technical infrastructure, or otherwise modify the Service.
Not every version, platform, device, or geographic region will necessarily have identical functionality.
A description of a feature in these Terms does not guarantee that the feature is currently available to every user.
32. Changes to These Terms
We may update these Terms when MediKin, applicable law, or our business practices change.
When we make material changes, we will update the effective date and provide additional notice where appropriate or required.
Where applicable law requires affirmative acceptance of revised Terms, we will request it before the revised Terms become binding on you.
Continuing to use MediKin after an update will have the effect permitted under applicable law and the notice provided to you.
33. Governing Law
These Terms are governed by the applicable laws of Nepal, without removing mandatory rights or protections that may apply to you under the laws of your jurisdiction.
Nothing in these Terms is intended to deprive a consumer of rights that cannot lawfully be waived by contract.
Any dispute-resolution or jurisdiction provision added to these Terms must comply with applicable mandatory consumer law.
34. Entire Agreement
These Terms, together with any additional terms that expressly apply to a particular MediKin feature, constitute the agreement between you and NeogenXAI concerning your use of MediKin.
The Privacy Policy describes our privacy practices and should be read together with these Terms.
If a particular optional feature requires additional terms or consent, those additional terms apply to that feature.
35. Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where permitted by law.
If it cannot be made enforceable, it will be severed to the minimum extent necessary.
The remaining provisions will continue in effect.
36. No Waiver
If NeogenXAI does not immediately enforce a provision of these Terms, that does not necessarily mean that NeogenXAI has waived the right to enforce it later.
Any waiver will apply only to the specific circumstances for which it is given, subject to applicable law.
